Following are the terms and conditions:

  • When the situation demands or allows, "we," "our," "us," and "Essence" refer to the Company and its connected bodies corporate (as defined in the Corporations Act 2001 (Cth), respectively.
  • The terms "you" and "your" refer to anybody accessing or using this website, including anyone making a reservation or buying a good or service online.
  • Essence Pty Limited, ACN 655 568 068 is referred to as the "Company."

  • Our use of any of our Websites is subject to these Terms and Conditions, including the Hotel Conditions of Sale. You accept these Terms and Conditions, including the Hotel Conditions of Sale, where applicable, by visiting any Website relevant.
  • If you do not agree to these terms and conditions, you should stop using the website immediately. You should avoid making any purchases or reservations at Essence Boutique Resort and Holiday Homes using our or any other affiliated website.
  • Any purchases made through the website must be made by people who are at least 18 years old. You guarantee that these Terms and Conditions and all applicable laws are followed when using this website. The Company maintains the right to prevent anybody it feels has violated these Terms and Conditions from accessing the Website or using its products or services.
  • By agreeing to the terms and conditions, you also give your consent to future marketing campaigns that may be sent by Essence Boutique Hotel & Holiday Homes Peregian Beach. You are able to unsubscribe if you wish to do so at any point in time.

 

Conditions of Sale for Hotels

  • These terms and conditions of sale apply to all reservations made through all Essence Hotels website, by phone, email, or in person and all travel agents selling Essence Boutique Hotel and Beach Homes accommodation inventory. The person making the reservation is presumed to have accepted these terms and conditions on behalf of all people who will be lodging at the Essence Boutique Hotel and Beach Homes under the reservation (once the reservation is accepted and confirmed by Essence.

  • All clients who make hotel reservations and payments in Australia are entering into a contract with the business.

 

Identification Documents with Photos and Further Check-in Details

  • When you check in at “essence” Boutique Hotel and Beach Homes you will be requested to present photographic and other forms of personal identification in addition to any data that Essence Boutique Hotel & Beach Homes is mandated by law to obtain.
  • Your reservation can be cancelled, and you might be required to pay us the entire value of the reservation plus any additional expenses we incur because of your reservation if you are unable to provide the requested identification or information. In these cases, any pre-payment made in connection with the reservation will be lost.
  • In any event Essence Management has the final decision

 

Reservations and Payment Policy

  • Bookings at an essence Boutique Hotel & Beach Resort Hotel are subject to the hotel's terms and conditions at the time of your stay as well as its current price.
  • A valid credit card must be used to ensure payment for reservations both when making them online, through a phone direct booking, through an essence or affiliated website and when checking in at the specific property (Essence Boutique Hotel and Beach Homes)

 

Deposit Procedure/Policy

  • When reserving a flexible rate online full payment is required to confirm a reservation. Reservations made on the applicable Essence Website with pricing that include limitations must be paid for at the time of the reservation. Please review each rate's conditions before finalising your reservation.

 

Payments

  • At the time of check-in at “Essence” a working credit card MUST be shown.
  • Payments can be done at “Essence” by EFTPOS, as well as using credit cards (as stated for online reservations or as shown as being accepted there).
  • Please be aware that there will be a credit card surcharge of 1.44% for all credit card transactions.
  • Despite the fact that you might not have checked out of our hotel, you agree to settle interim accounts when they are provided.
  • Essence Management retains the right to sole discretion.
  • You acknowledge that any fees for services rendered to you after your departure may be added to your account for settlement as negotiated, charged to the same credit card used to pay the account at the time of departure, or charged to the credit card used to guarantee payment of your account.
  • For security reasons, visitors must present a valid piece of government-issued photographic identification upon arrival at Essence Boutique Resort & Holiday Beach Houses. In order to reserve the room, the guest must additionally present a credit card with the same name as the picture ID. A AUD $100 credit card pre-authorization for the Hotel (Studios & Apartments) and AUD $500 credit card pre-authorization for the Beach Homes
  • “Essence” Peregian is a cashless Resort. The credit card merchant will hold onto any pre-authorized funds for up to 10 working days (release times may vary, please check with the issuing financial institution). Your spending limit or available money balance will be impacted by the pre-authorization.
  • We advise the cardholder to get in touch with their credit card provider for further information on this procedure. Until we complete the final account on departure, we cannot release, delete, or decrease the authorised amount once a pre-authorization has been made. This is a limitation that financial institutions have imposed on us and cannot be changed.
  • All credit cards must be pre-authorized by essence Boutique Hotel & Holiday Homes upon check-in. Please be aware that this procedure verifies the credit card being provided and safeguards the cardholder as well as the credit card merchant against rising fraud incidences. When staying at essence Boutique Hotel and Beach Houses, cash is not a suitable form of payment (We are a strictly cashless Resort), and a valid credit card must be shown upon arrival.

 

Prices and Fees

You acknowledge that up to the point when you notify us that you have left the essence Boutique Hotel, you will pay to us any outstanding hotel rate for each day of your stay and any extra fees. (But not limited to, upgrades, F&B outstanding invoices, additional cleaning fees, lobby shop purchases) upon departure.

 

Hotels in Australia

  • GST is included in all listed prices, which are given per room, per night, and are expressed in the local currency of the nation where the essence Boutique Resort is situated (i.e., Australian as appropriate).

 

Check-in

  • 3pm is the standard check-in time.
  • You acknowledge that if your necessary check-in time necessitates us keeping the accommodation unoccupied on the preceding day, we may charge you.
  • If the number of people using the accommodation changes, you are responsible for notifying us and agreeing to pay any additional fees for those who were not originally mentioned at the time of registration.

 

Check-out

  • Unless we agree to another time, check-out time is 11:00 am on the day indicated for your departure.
  • After that period, there may be an extra hotel charge.
  • Unless we have agreed to a prior settlement, you are and will remain individually responsible for the whole sum payable at departure. You agree to pay the full amount owing upon receipt of our invoice, which shall be immediately due and payable before check out.

 

Minors

  • A parent, legal guardian, or other adult with parental rights and obligations for the under-18-year-old visitor must be with minors at all times.
  • The Company retains the right to immediately cancel the visitor's reservation and keep the entire booking fee if the guest is under the age of 18 and is not accompanied by a parent, legal guardian, or other adult as specified. In such cases, the Company shall not be liable to the Guest or any other person with respect to the booking and will retain all monies paid at the time.

 

Unique Requests

  • While the Company will make every effort to meet any specific requests for bookings, it cannot and does not guarantee that it will.

 

Facilities and Services

  • While every effort is made to ensure that the information on our facilities and services is accurate, keep in mind that these things are often updated, altered, and even taken out of commision. It is your duty to check with the essence Boutique Hotel to make sure the feature or facility will be available during your stay if any specific feature or amenity is important to you when choosing a hotel.
  • Hotel is not responsible for any omissions, mistakes, or modifications to the amenities and services at a hotel, whether temporary or long-term, to the degree authorised by law.
  • The stated accommodations might not be available for all room types.

 

  • Products and Services from Third Parties
  • Essence Resort occasionally offers goods or services from outside vendors in special packages or hosts outside vendors in its lodgings. The failure of third-party suppliers to provide goods or services, as well as any mistakes, alterations, or changes of any sort made by such third-party providers after they have accepted a booking, are not under any circumstances the responsibility of Essence.
  • All third-party coupons, vouchers, receipts, and tickets are issued in accordance with their terms and conditions.
  • The correctness of any information, claims, or representations provided by third parties is not guaranteed by Essence Resort, and the Company is not responsible for their actions, mistakes, or carelessness.

 

Indemnities and Releases

  • Money, any valuables, products, or cars that you bring into or onto the room, premises, or parking lot are all your responsibility; we are not liable for keeping them secure.
  • You undertake to indemnify and hold Essence Resort, its officers, owners, employees, and agents, to the fullest extent authorised by law, harmless from any and all costs, liabilities, claims, and actions, arising out of, connected with, resulting from, attributable to, or resulting from your reservation, your stay, or your attendance at any event at Essence Resort for any reason whatsoever, proceedings, damages, judgments, and losses of any kind (including consequential and economic losses, property loss/damage, and damage for injury, including personal injury and death).
  • You agree to indemnify Essence Resort and its current and former officers, owners, employees and agents for all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) incurred or suffered by Essence Resort or its current or former officers, employees or agents arising out of, caused by, attributable to, or resulting from your reservation, your stay, or your attendance at any event at Essence Resort, except to the extent that the loss as described above was caused by or contributed to by Essence Resort or its current or former officers’, employees’ or agents’ negligence.
  • You agree that regardless of your length of stay at any Essence Hotel room or beach home there is no tenancy or any other proprietary rights created under any laws.
  • We grant you a licence to stay in our hotel and we reserve the right to terminate the licence at any time.

 

Pictures and videos

  • Without prior written approval from hotel management and, in the case of photography and videography, without a signed authorised site acknowledgement, any commercial or promotional activity (including photography and videography) is forbidden throughout the Essence Resort. The hotel management has the authority to reject services and order a halt to any action that contravenes this rule. Any prohibited images or films must be swiftly removed from the internet and distributed elsewhere upon hotel management's request.

 

Use of Information

  • You agree and authorise the Company and the Essence Resort to collect, use, and disclose your personal information for the administration of your reservation and the provision of services to you related to your reservation. You will have the option to unsubscribe from our marketing email list at any time as stated in our Privacy Policy, however we may use your information to alert you about promotional activities.
  • You accept that we may send you information about your stay at a Essence Resort using your email address. For further information on the gathering and use of your personal information, please refer to our Privacy Policy.

 

Privacy

  • When you visit or attend an event at Essence Resort, we may occasionally gather personal data about you and/or others who are with you.
  • All personal information is handled by Essence Resort in line with the applicable privacy laws and its Privacy Policy. You may read a copy of the Essence Resort privacy policy at Privacy Policy.
  • You consent to the collection and use of your personal information by the Company in accordance with the Privacy Policy when you use this website, make a purchase from it, or submit any information to it, including when making a reservation at Essence Resort

 

Errors with Bookings and Fraudulent Activity

  • When a person makes a reservation at Essence Resort, Essence Resort is not liable for any inaccurate information they supply at that time or for any technical or human mistake that may arise during the processing of such information.
  • When it seems that a user has participated in dishonest or improper behaviour, or in other situations where it appears that the reservation contains or was the product of an error or mistake, Essence Resort may cancel or alter any reservation.
  • Management will have sole discretion regarding the above

 

PRE-AUTHORISATIONS POLICY

  • A minimum pre-authorisation amount of $100 for studios/apartments plus any remaining balance of accommodation charges will be deducted from the credit card provided.
  • A minimum pre-authorisation amount of $500 for Beach Homes plus any remaining balance of accommodation charges will be deducted from the credit card provided.

 

PAYMENT POLICY

  • All short term holiday accommodation bookings with Essence are subject to these Terms and Conditions, which include any other Terms and Conditions stipulated on our websites, in your booking confirmation or otherwise in writing prior to check-in.

A booking, including an online booking, is not complete unless accepted by us via a booking confirmation email or otherwise in writing.

All bookings are subject to a non-refundable booking fee of 10%, payable in accordance with clauses below, as applicable at the time of the booking.

  • Full payment of the tariff and all other fees and charges (together, the “Accommodation Charge”) is required within 24hrs at the time of booking for all bookings.
  • On completion of your booking, you will receive a booking confirmation email containing the details of your booking and itinerary. It is essential that you check the accuracy of your booking confirmation and contact staff within 24hrs to amend any incorrect details.
  • CHECK IN AND CHECK OUTS SCHEDULED ON CHRISTMAS DAY, BOXING DAY AND NEW YEARS DAY ARE NOT AVAILABLE.

 

Security Bond Authority

  • Unless otherwise indicated a credit card security bond is $100 for the Hotel Studios and 2 bedroom apartments and $500 for all beach homes. The bond must be preauthorised/paid prior to the check-in date. Where credit card details are provided, they may be stored securely and processed in accordance with these terms and conditions and any applicable laws and regulations (including the Australian Consumer Law). You acknowledge that you will not be permitted entry to the property during any period that the security bond remains unprocessed.
  • You agree that the security bond may be used by us without reference to you in order to meet any fees or costs associated with:
  1. making good the property as a result of your use, misuse or neglect; or
  2. any other breach of these Terms and Conditions rules (including but not limited to costs incurred for supplementary cleaning including Covid-19 related requirements, call outs and/or security services) (collectively, “damages”).

Preauthorised bonds will be released under the terms of the merchant. Where a bond is actually paid we will endeavour to refund within 10 working days of departure, provided no claims for damages have been made. Should a claim for damages be made, we shall retain so much of the bond as we, in our absolute discretion, consider is sufficient to rectify the damages. We will return any balance to you as soon as practicable.

 

Cancellation, Refund and Date Change Policy

 

  • Essence Boutique Hotel
  • The guest can cancel until 3 days before arrival for a 10% cancelation charge. The guest will be charged the total price of the reservation if they cancel in the 3 days before arrival.
  • A cancellation fee that will be charged to the credit card used to guarantee payment of your account will apply to any cancellations made after this time or any no-shows for a reservation.
  • During showtime and peak periods to be determined by essence and subject to change at anytime;
  • The guest can cancel until 30 days before arrival for a 10% cancelation charge. The guest will be charged the total price of the reservation if they cancel in the 30 days before arrival.
  • A cancellation fee that will be charged to the credit card used to guarantee payment of your account will apply to any cancellations made after this time or any no-shows for a reservation.
  • Early Departure Policy & No Show Policy - After check-in, should you shorten your scheduled departure date no refunds will be provided. In the case of a No Show, a fee of up to seven night's accommodation will be incurred.
  • The General Manager of Essence Resort has the final say on any requests for revisions or changes to reservations.
  • The replacement reservation must be made within 12 months of the initial reservation.
  • One change of date is available per reservation only available at no cost up to 3 days prior to arrival for Low and High Seasons and 30 days prior to arrival for Peak and Showtime seasons.
  • If the tariff for the new dates is higher than the original booking dates than the tariff will be calculated using the rates for the new booking dates.
  • If the tariff for the new dates is lower than the original booking dates than the tariff will be calculated using the original booking dates.

 

Essence Boutique Beach Holiday Homes

  • The guest can cancel for at 10% charge until 30 days before arrival. The guest will be charged the total price of the reservation if they cancel in the 30 days before arrival.
  • A cancellation fee that will be charged to the credit card used to guarantee payment of your account will apply to any cancellations made after this time or any no-shows for a reservation.
  • During showtime and peak periods to be determined by essence and subject to change at anytime;
  • The guest can cancel for a 10% charge until 60 days before arrival. The guest will be charged the total price of the reservation if they cancel in the 60 days before arrival.
  • A cancellation fee that will be charged to the credit card used to guarantee payment of your account will apply to any cancellations made after this time or any no-shows for a reservation.
  • Early Departure Policy & No Show Policy - After check-in, should you shorten your scheduled departure date no refunds will be provided. In the case of a No Show, a fee of up to seven night's accommodation will be incurred.

  • We firmly advise you to buy travel insurance to protect yourself against any unforeseen events, such as loss of the deposit, flight cancellations, cancellation fees, medical costs, and loss of any personal belongings while travelling.
  • The property will use all reasonable efforts to make it available as scheduled. However, the property has the right to modify reservations in the event of unanticipated events.
  • If you are unable to complete your booking due to government travel restrictions related to Covid 19 and you cancel your booking within 30 days of arrival, our standard terms apply, however, you will be offered a credit of equivalent value on a future stay at the same property (subject to our standard terms, current applicable tariffs and availability), to be redeemed within 12 months of your original departure date. This credit is not transferable. Transfer dates cannot be booked in peak periods eg. Christmas, New Year, Easter and school holidays.
  • If you are intending to book or stay, by agreeing to these terms, you warrant that all guests are not subject to travel and public health order restrictions and are covid free.

 

Check in and Check Out Policy

  • For the safety and security of our hotel, associates and valued guests, a valid credit card and photographic identification in the form of a driver’s license or passport must be presented and may be photocopied upon check-in. Early arrival access to the pool area is not guaranteed.

Check-in time is strictly 3:00 pm unless otherwise specified in your booking confirmation.

Check-out time is strictly 11:00 am unless otherwise specified in your booking confirmation.

Late check-outs are not permitted save by prior agreement in writing. Additional fees and charges may apply to late check-outs.

Information about the collection and return of key cards is specified in your booking confirmation.

  • If the property or its contents is damaged at the time of your check-in you must notify us immediately. Essence does not accept responsibility for any such items.

At the completion of your stay, the property must be left in the condition it was in at check-in, including but not limited to:

  1. Washing and returning all kitchen utensils, crockery, glasses and cookware to their original location;
  2. Returning all furniture to its original location;
  3. Removing all rubbish and placing it in the external bins provided; and
  4. Locking all windows and doors.

 

Nature of Booking Policy

  • You acknowledge that, subject to these terms and conditions, a valid and fully paid booking:
  1. grants a limited licence to occupy the property for short term holiday accommodation during the agreed booking term for the guests specified in the booking; and
  2. does not constitute a residential tenancy.

You acknowledge that, to the extent permitted by law, any description of the property:

  1. is indicative only;
  2. is not a warranty in respect to the location, aspect, size, nature, quality, finish or condition of the property or any contents;
  3. if inaccurate, does not give you a right to cancel or change your booking unless such description is materially misleading.
  • If your booking becomes unavailable for any reason outside our direct control we will:
  1. endeavour to arrange replacement accommodation; or (if unavailable only)
  2. refund the payments you have made (which will be the limit of our liability to you); and
  3. not be responsible for any other losses, costs, damages or expenses however described.

Noise or disruption from maintenance, construction or public works on nearby property is not grounds for cancellation of your booking or compensation. Where we become aware of such works prior to confirmation of your booking, we will endeavour to inform you.

You acknowledge that it is a condition of your booking that you are responsible to hold appropriate holiday insurances in respect your booking and holiday, and the nature of your policy and inclusions is your responsibility to determine.

 

Use of Property

  • You will be required to nominate the number and age of guests staying at the property when booking, which must be no more than the maximum stipulated for the property or each bedroom on our website and that the majority of guests are over 21. You are responsible to ensure all guests comply with these terms and conditions.
  • Only registered guests of the hotel and beach homes are permitted access to the property and facilities. If access is provided to visitors who are not registered guests, the right is reserved to evict all guests in breach and retain all monies paid. The property is to be used for holiday accommodation only. The use of a property for business or commercial use, special interest groups, including schoolies, weddings, functions, parties of more than [5] guests or any other like gathering are strictly prohibited unless with our prior written agreement. Should it come to our attention that a booking has been made or a property is being used in breach of this clause, without limiting any other provision in these terms and conditions, we reserve the right to cancel the booking at any time, refuse key collection upon arrival and/or immediately evict the occupants without refund.
  • You must not damage the property, contents or any associated common property, or cause excessive noise or a nuisance at or around the property. The Holiday Letting Organisation operates a noisy neighbour hotline which responds to noise complaints by neighbours, residents, and other holiday makers. If a complaint of excessive noise or anti-social behaviour is received, security will be dispatched to investigate and may result in a $200 call-out charge. A report will be sent to our office with information as to whether a fee has been charged. This fee will be taken from the security bond and is non-negotiable. If a second security call-out with fee payable is received at any time during a guest’s stay, all guests at the premises will be evicted from the premises by security without refund of rent or bond.

 

Services Policy – Cleaning, Linen, internet etc.

  • Our properties are serviced during your stay unless otherwise stipulated by the guest. We also have “green cleans available every 3 days, if guests are interested in reducing their footprint.
  • Our properties are provided with bed, bathroom and kitchen linen for the number of guests stipulated at the time of booking. Linen hire fees are included in the Accommodation Payment. Extra linen may be arranged within 7 days of arrival at your cost, subject to availability. Our properties are cleaned prior to and following your stay. Applicable cleaning charges are included in your Accommodation Payment. Additional cleaning may be arranged within 7 days of arrival at your cost, subject to availability.
  • We will endeavour to have repairs to substantially damaged or malfunctioning fixtures, fittings and appliances (“Malfunctions”) attended to as soon as possible after being reported. If repairs to appliances cannot be attended to, we will endeavour to supply a substitute appliance. Malfunctions shall not be grounds for cancellation of bookings or compensation.
  • During your stay, our staff or tradespeople may enter the property to carry out an inspection or to complete repairs or maintenance. We will endeavour to minimise any inconvenience and give you prior notice where possible.
  • You indemnify us and the owner of the property in respect of any and all claims, actions, suits, demands, costs, damages and expenses arising in connection with your stay at the property.

You release us and the owner of the property in respect of any and all claims, actions, suits, demands, costs, damages and expenses arising in connection with your stay at the property except to the extent of any negligence on the part of the released party.

 

Booking Changes Policy

  • We will endeavour to accommodate requests for changes to your booking. However, any changes to your booking later than 24hrs from booking confirmation will constitute a cancellation of the original booking and additional booking fees and accommodation charges may apply.
  • Bookings are not transferable and changing dates of stay constitutes a cancellation. We reserve the right to cancel any online or booking that isn’t in accordance with the booking terms for the property or due to owner/operator error and refund any tariff paid where applicable. Credits applied due to Covid-19 are non-refundable.

 

Privacy Policy

  • We respect your privacy and will only disclose your personal information:
  1. to our staff and external service providers to the extent necessary to manage your booking and your stay; and
  2. to other parties if you provide your consent.

 

GENERAL TENANCY RULES

  • It is your duty to have read and understood the Terms and Conditions before making a booking and paying a deposit. You must stay informed of any modifications to these Terms and Conditions, which will be posted on our website, as Essence Management retain the right to make them at any time, in whole or in part.
  • Guests are required to constantly check that these Terms and Conditions are being followed. A violation on their part will be regarded as a violation on your part. If you violate these terms and conditions, you risk being ejected off the property, losing your bond (if applicable), having money deducted from your credit card, and losing all of the money you've already paid.
  • Guests are reminded that the access to the property is for paying registered guests only for their peaceful enjoyment. Visitors are not permitted access to the property.
  • We shall repair the property at the guest's expense if it is damaged due to an accident, negligence, or wilful act by the visitor or the visitor's invited guests. A report of malicious damage shall be filed with the police for any damage over $500. For any repairs made to the property or for any fees that have been asserted against you, we are not required to provide you a tax invoice.
  • The property may only be used for short term holiday residential purposes. The booking will be immediately terminated, the guest(s) and other occupants removed from the property, and all additional costs or expenses (including a function/extra cleaning fee) will be deducted from the bond money paid and or a charge processed against the guest's credit card (at our sole discretion). If there are insufficient funds, the debt will be turned over to a debt collection agency or the courts for payment of the amount plus expenses associated with recovery.
  • The individual who makes a booking is deemed to have accepted the terms of the booking on behalf of each individual mentioned in the booking. Booking Terms and Conditions are deemed to have been accepted on behalf of all parties listed in the booking by the person who makes or confirms the reservation on their behalf.
  • Essence Boutique Holiday Homes retains the right to enter the property at any time during your stay.

 

Guests Must

  • Treat other guests with courtesy and consideration, and keep noise to an acceptable level, especially between 10pm-7.30am
  • Follow parking guidelines. Parking is available in the allocated space or garage associated with each room and house. One space is provided for Hotel rooms and Two Bedroom Apartments and a double garage in each house. Wallum houses have an additional car port. Boats, Jet skis, trailers and RV’s parking is not permitted.
  • Get rid of trash in accordance with the property's custom.
  • Extra trash, bottles, etc. must be removed from the property in order to avoid collection and disposal expenses.
  • Report any problems or grievances to the management as soon as you can.
  • Take care of registered paying guests and uphold the location's security.
  • Comply with all police and regulatory authority orders, and abstain from engaging in any illegal, intoxicated, offensive, or obscene behaviour.
  • Provide honest and accurate information when requested to do so at check-in and during your stay with us. If a guest provides false or deceptive information, Essence maintains the right to cancel the reservation immediately and retain all monies paid.
  • Permit Essence team members/Owner/Directors to enter the premises if necessary.

 

RATES

  • Rates/Tariffs, prices, and quotes are not guaranteed until a deposit has been processed and you have obtained official written confirmation from Essence or the booking agent. They are also subject to change without notice.
  • Minimum 7-night stays are required during our “showtime season”. Showtime dates are subject to change at anytime. Please refer to below for 2023 example

  • Although the prices on our website are subject to change, your rate is locked in once you have made a deposit. After you have paid your deposit, we are unable to change the rate if any offers are offered or lower prices are published.
  • Unless otherwise stated, rates do not include personal items, meals, transfers, current or projected taxes, or government fees.
  • Any verbal price quote is simply an estimate; the final price will be confirmed in writing after the reservation is confirmed. During times of special events, there can be limitations on the minimum length of stay for some tariffs/rates. At the time of booking, all costs, fees, and other terms should be confirmed.

 

EXTRA FEES

  • 4.1 A $20.00 re-processing fee can be charged if a credit card transaction is rejected for any reason.
  • The specified price is applicable to all hire products.
  • A replacement price of $500 per (hard key) be charged for any misplaced/lost keys. If something occurs while you are a guest, you must inform the Essence team immediately.
  • After Hours Call-outs- We will be able to assist our guests with matters arising outside our office hours (7:00am to 8:00pm Sunday to Thursday and 7am-10pm Friday to Saturday) A call-out fee of $180 will be charged to the credit card on file.
  • There is a 1.44% surcharge for all credit cards.
  • You are not permitted any additional guests once your allotment is filled. If guests change, Essence team must be notified.

  • To secure your reservation, a 25% deposit of the total rental cost must be paid at the time of booking using one of our accepted payment options.
  • Your credit card on file will be automatically charged the balance if it is not paid in full at least 3 days before your scheduled arrival. It is your duty to make sure there is clear money on hand on this day.
  • You must inform us in writing seven business days before the due date of your payment if you want to send your final payment by EFT transfer.
  • Full payment, including any bond funds, is expected at the time of booking for reservations made less than 3 days before your arrival.
  • To validate your card information before your trip, at least one payment must be made using a credit card.
  • A $100 pre-authorisation is necessary for all hotel rooms, and it must be taken at arrival.
  • Essence Boutique Holiday Beach Homes

  • Pre-authorisations won't be released until the property has been examined and determined to have been left in a condition identical to when you arrived. The security deposit and, if necessary, the credit card, will be used to cover any costs associated with any damage, loss, or expense resulting from your violation of these terms and conditions. This includes, but is not limited to, any breakage, damage, or excessive cleaning needs, additional visitors beyond those who have been declared, and security call-outs. If any of the aforementioned reasons warrant a deduction, an administration fee of $50 to $300 will also be applied to cover the cost of organising item replacement or repair, among other things.
  • Holiday Home keys will be charged at $500 if lost or damaged to cover the cost of changing the locks and replacement keys and will be deducted from your credit card provided on arrival.
  • If the pre-authorisation of $500 is not actioned in accordance with the aforementioned terms, we reserve the right to deny your check-in and lose all payments made.
  • If pre-authorization funds are not available before check-in, keys will not be given out and your reservation will be cancelled.
  • You will be contacted by phone and the email address connected to your booking if a pre-authorisation deduction is made.
  • Common forms of payment accepted include credit cards (Mastercard and Visa), electronic funds transfers, and bank wire transfers (allow 7 days transaction time).
  • All payments must be made in Australian dollars less any bank fees or other transaction costs.

 

TERMINATIONS & REFUNDS BY AGENT

  • We shall make every effort to identify suitable alternative arrangements if the premises are rendered unavailable for whatever reason prior to or during your stay. If suitable alternatives cannot be found, we will return any payments received for the portion of the booking that was not met.
  • Essence Peregian disclaims all liability in the event that a property is no longer available for booking, is sold, or the agent's authority to act is terminated, causing your reservation to be cancelled.
  • Essence Peregian reserves the right to determine the amount to be reimbursed, if any, in the event that guests elect to end their stay after arrival due to dissatisfaction with any part of their accommodations.

 

COMINGS & LEAVINGS

  • For Essence Boutique Holiday Homes, check-in begins at 3pm.

 

  • Check-in timings are simply a suggestion; if your check-in time is later than expected for any reason, there will be no reimbursement.
  • Reception Times

Sunday – Thursday 7am-8pm

Friday-Saturday 7am-10pm

 

  • Please note there will be no check ins available outside after this time.

 

  • Check-out time must be completed by 11.00am. There is NO flexibility that permits for a later check-out since we use contract cleaners (unless approved prior in writing).
  • Late checkouts are available at the below rates subject to availability

o Hotel Room: $40 per hour up until 5pm. After 5pm a full night tariff is charged.

o 2 Bedroom Apartment: $50 per hour up until 5pm. After 5pm a full night tariff is charged

o Beach Homes: $350 up until 5pm. After 5pm a full night tariff is charged.

  • The guest hereby authorises Essence to automatically withdraw a late checkout fee from the bond and/or credit card for a late check-out.

 

USAGE OF THE PROPERTY

  • The property must be returned to the same condition as when it was first occupied. There will be additional fees if you don't vacate the property in a timely manner. You give us permission to charge you for any extra fees we have to pay to clean the property after you leave, in our sole discretion.
  • The home must be properly secured and deserted when you leave. Put all trash in the supplied bins or remove it from the premises. It is necessary to clean and store all of the flatware and dishes. All furniture and other items must be returned to their original positions. It is required that the premises be left orderly and clean.
  • Unless you have given us previous notice and extra bedding arrangements have been made, the number of visitors at the property will never go over the number agreed to under our terms and conditions stated below.

3 bedroom houses = Maximum 6 guests

4 bedroom houses = Maximum 8 guests

5 bedroom houses = Maximum 10 guests

 

  • We reserve the right to cancel your reservation at any time without prior notice if there are more guests than are declared at the property at check-in or at any other point during your stay, and all rent payments will be refunded.
  • Due to fire and health regulations, guests are not permitted to sleep on couches or in any other spaces outside the provided beds.
  • BBQ's and gas bottles can not be used on balcony's or with the Hotel.
  • You are not allowed to use the area for any illegal activities.
  • There is no smoking allowed anywhere on the Resort. This is strictly a non-smoking Resort in all areas. If smoking is discovered, the guest will be responsible for paying the costs of cleaning the property to get rid of all traces of cigarette smoke. Soft furniture and other items can be dry cleaned in this. While smoking is generally permitted outside of the Resort complex, it is not permitted closer than five (5) metres from any doorway entrance to the Resort.
  • No furniture should be relocated outside, and only outdoor furniture should be used.
  • It is NOT allowed to retune TVs.
  • The Boutique Holiday Homes are for private domestic holiday use only and is STRICTLY PROHIBITED for parties and other functions. The additional expenditures related with functions, such as those for cleaning, garbage disposal, wear and tear, maintenance, etc. are not included in this rate. It is strictly forbidden to disturb nearby neighbours, including by making excessive noise.
  • You use any equipment that is provided or accessible on the property at your own risk. (Eg swimming pools)

 

  • You are required to follow any reasonable instructions we may give you. We reserve the right to access the property at any time and for any reason to verify that these Terms and Conditions are being followed.
  • Once the keys have been handed over, it is the guest/s' obligation to maintain the security of the property. This includes keeping all doors, windows, and garage doors secured at all times.
  • You are required to always use the property safely. We reserve the right to cancel your reservation and keep all fees paid if it is determined that you or one of your guests may not be using the property in a safe manner. Essence Peregian has the last say in this.
  • If a guest reports maintenance, you could be asked to assist with basic troubleshooting before a tradesperson arrives at the property. We do have maintenance onsite Monday to Friday during business hours (Excluding Public Holidays)
  • Guests must be at least eighteen (18) years old, or they must be accompanied by someone who is.

 

BREACHES

  • A major breach of this agreement will result in your eviction, the forfeiture of your pre-authorisation and/or a charge to your credit card on file if you fail to adhere to any of the aforementioned conditions.
  • Any damage that exceeds $500 will be reported to the police as malicious damage, and criminal proceedings may be brought against the offender.

 

POOLS FOR SWIMMING

  • In the pool area, neither you nor your visitors may use glass or glass-related products.
  • Ensure that kids are always under adult supervision.
  • Children are not permitted to use swimming pools without an adult present.
  • Refrain from running near the pools.
  • Equipment for cleaning and filtering swimming pools must not be tampered with. Additional fees will be assessed if the pool equipment is not returned in the same condition that it was given at check-in. Essence Peregian Management has the last say on this.
  • Before leaving, all inflatable pool accessories must be taken out of the pool.

 

DAMAGE, LOSS, AND INJURY

  • You use the facility, the equipment, and the property at your own risk.
  • During your visit, you are liable for any damage, breakages, theft, or loss of items on the property or in the surrounding area (including keys). You shall be liable for all associated costs for the repair or replacement of any affected property if any are thus affected. By making a reservation and paying a deposit, you give Essence permission to deduct the expenses from your bond, any money you have paid (or owing), and/or to charge your credit card on file.
  • Neither Essence Peregian nor other property's owner accepts liability for any loss or theft of your personal belongings or for any injuries sustained while on the property.
  • Essence disclaims all liability for any injury, damage, or loss to persons or property caused by any act, omission, default, or negligence on the part of itself, its employees, or its agents. They also make no warranty regarding and assume no responsibility for the accuracy of any information provided in statements made by their service providers regarding travel arrangements. By using Essence Peregian Boutique Resort, you acknowledge and agree that: Essence Boutique Holiday Homes/Resort Hotel shall not be liable for the wilful or negligent acts and/or omissions of such carriers and/or service providers.
  • Essence Boutique Holiday Resort will not be held responsible for any incident involving lodging, transportation, or other travel services that results directly or indirectly from circumstances or events outside of its control, such as acts of terrorism, acts of God, vehicle defects, war, strikes, theft, delay, cancellation, civil unrest, disaster, government action, or any other such event.

 

PARTIES

  • Parties are categorically NOT permitted on the premises. A party is defined at our sole discretion to include any circumstance in which the maximum number of guests permitted per premises is exceeded, the noise level is deemed to be too high, excessive traffic to and from the premises is noted, intoxication and/or excessive alcohol is present. Only paying registered guests are permitted access to the property.

 

  • Essence reserve the right to promptly evict all tenants and cancel your reservation if any rental is determined to be hosting a party (at our sole discretion). All rent payments made in the event of this will be lost. Additionally, any costs for cleaning, replacement of any broken or missing furniture or fixtures, lost keys, and repairs will be taken from the bond or charged to your credit card.

 

EVICTIONS:

  • Essence Management reserve the right to immediately evict any guest, visitor, or member of the public for any of the following reasons, including but not limited to: intoxication and/or unsavoury/lewd behaviour; wilful damage to the premises; physical or verbal abuse/assault of our staff, other guests, residents, members of the public on or around the premises; behaviour deemed to be a potential safety threat to others; and any violation of the Terms and Conditions.

 

WASHING & LINENS

  • Properties are completely self-sufficient and do not require daily maintenance. If you need any additional services, please let us know before you arrive (charges will apply).
  • When leaving, kindly make sure the place is left spotless. Every piece of cutlery and utensil needs to be cleaned and reorganised in the cabinets. The arrangement of all furniture must be maintained from the time of check-in. Any further cleaning or moving of furnishings within the property will incur fees.
  • Before leaving the property, all trash and bottles must be taken out and put in the appropriate trash cans. Additional fees will apply to any extra items left on the premises.
  • After you leave, we are not liable for any objects left behind.
  • The guest is responsible for paying for any requests for additional linens (1 towel per person is provided; more towels can be provided on request. If this is not scheduled before check-in, a call-out fee can be charged.

 

ADDITIONAL FEES AND CHARGES THAT COULD APPLY

  • At the time of booking or at any point during your stay, we retain the right to charge you a bond and/or a credit card authorisation. Incidental expenses, including but not limited to consumables, breakages, additional cleaning costs, etc., may be covered by the bond or pre-auth. After you check out, the property will be inspected, and the bond will be returned to you, less any incidental items, fees, and penalties.
  • The credit card company may reserve the pre-authorized amount for up to 10 days. Your spending limit or available money balance will be impacted by the pre-authorization. We advise the cardholder to get in touch with their card issuer if they want further information about this practise. Until we complete the final account on departure, we cannot release, remove, or lower the authorised amount after a pre-authorization has been made. This is a merchant-specific procedure that cannot be altered.
  • If you gave us your credit card information, you give us permission to deduct the full amount of your final rental payment as well as any additional fees or charges outlined in this Agreement from your credit card.
  • You will be responsible for paying a $300 call out fee if a security guard is dispatched due to a noise complaint while you are on the property. A second complaint will result in eviction and you won't get your money back.
  • Fees will be charged if, without our previous written consent, the property is occupied by more guests than the number listed on the confirmation email of your reservation.
  • You are responsible for covering all related expenses for repairing or replacing any lost, stolen, or damaged property on or around the premises.
  • At Essence’s sole discretion, we reserve the right to impose a special cleaning fee on you to cover the fair expense of any additional cleaning that is necessary as a result of your occupancy. You acknowledge that we are not obligated to send you a tax invoice.
  • If you ask to have any lost property sent to you after you leave, the recipient will be responsible for paying the $75.00 admin fee, which covers our agents' effort in organising, collecting, and mailing the item to you.

 

Pet Policy

  • Pets are strictly not allowed anywhere in the resort or holiday homes. Guests that fail to comply with this rule, will be removed from the Resort/ Holiday home and the monies paid will be forfeited.

Service Dogs

  • A Service dog is allowed in essence Hotel and Holiday Homes on the condition that the dog;
  • Is a service dog (Guide, hearing or assistance Dog) that has been trained to assist a person with a disability, to alleviate the effects of that disability; and
  • Has been certified or accredited by a training organisation or trainer that:
  • Is a full member of Assistance Dogs International (ADI); or
  • Is approved under the Queensland Guide, Hearing and Assistance Dogs Act 2009 (Queensland Act); and
  • Has a current Public Access Test (PAT) and meets the appropriate standards of hygiene, behaviour and safety for an animal in a public place; and
  • Has not been declared a dangerous dog or restricted breed; and
  • Does not have any infectious disease or pose a threat to public health or the health of other animals.
  • If guests are intending on bringing a service dog, proof of registration must be submitted at the time of booking. Service dogs are exempt from additional fees; however, guests are still responsible for any damage the animal might cause. It is the responsibility of the guests to ensure all waste is properly disposed in the allocated areas.

 

INFORMATION ON RENTAL OPTIONS

  • While every effort is made to maintain the accuracy of the description of Essence’s Resorts amenities and services, these are frequently updated, revised, and even taken out of operation. It is advised that the guest check with the reservation staff at the time of booking whether any particular amenity or feature is crucial to their decision to stay at a certain resort. When it comes to a property's amenities and services, Essence’s Resort is not responsible for any omissions or mistakes, whether they are transient or permanent.
  • Although they are subject to modification and normal wear and tear, the photographs depict the property as it was at the time the picture was taken. Personal views are not the responsibility of Essence Resort or the property owner.
  • Electrical appliances, swimming pools, and air conditioners are all susceptible to breakdowns and occasionally sluggish repairs. Any breakdown should be reported as soon as possible. While every attempt will be made to have these things fixed as soon as possible, there is no assurance that they will be available or functional for the duration of a stay. There is no duty on the part of the owner or agent to offer a discount or compensation in the event that appliances or additions have flaws or malfunction. We shall not be held liable for any difficulty caused by equipment failure, but we will use every effort to fix or replace the item.
  • In the unlikely event that a guest is dissatisfied with any part of their lodging, Essence’s Resort will under no circumstances return any rental fees that have already been paid (including before, during, or after check out). Essence’s Resort shall receive written complaints only.
  • Free Wi-Fi is offered, it is only intended for personal domestic use (internet browsing) and is not intended for use for downloading large files or for business reasons. Internet signal strength and speed are not guaranteed. The agent is under no obligation to provide refunds or other forms of compensation if the Wi-Fi is unavailable during your stay for whatever reason.

 

RENT, ADDITIONAL, OR RECREATIONAL EQUIPMENT

  • You use everything on the property, whether it was provided for free or was rented out, at your own risk.
  • Before using any hired, supplementary, or recreational equipment, it is your responsibility to give it a complete inspection.
  • If you have any safety concerns at all or are not happy with the terms under which any rental, extra, or recreational equipment is offered, do not use the item(s).
  • Please make sure to ask any questions you may have about the aforementioned Terms & Conditions prior to making your reservation.
